The Supreme Constitutional Court, in its session held today, Saturday, headed by Counselor Boulos Fahmy Iskandar, ruled that the list of employees of the Supreme Council of the Press issued by the President of the Supreme Press Council’s decision No. 5 of 1987 and its amendment issued by the Supreme Press Council’s office decision No. 5 of 1993 is unconstitutional.

In the reasons for its ruling, the court said that notifying the addressees of the legal rule of its content is a condition for informing them of its content, and its enforcement was supposed to be announced through its publication and the time specified for its entry into force. The dissemination of its rulings and its connection with those concerned with it, and refraining from saying that they are ignorant of it, and its publication was a guarantee that they would stand on its essence, content and scope, and prevent them from avoiding it.

The court added that the application of the legal rule to those addressed before its publication constitutes a violation of their freedoms and the rights guaranteed to them by the constitution.

And since it is established that these regulations and their amendment were not published in the Official Gazette, the Egyptian Gazette, then the judiciary of their unconstitutionality is specific, and the consequent fall of the second paragraph of Article (82) of the Law of Institutional Organization of the Press and Media; Because it contained the continuation of the provisions of the aforementioned executive regulations, until that law was canceled with the issuance of the Press and Media Regulation Law and the Supreme Council for Media Regulation by Law No. 180 of 2018.
